Data protection statement
- We process personal data (i.e. data that directly or indirectly identifies natural persons) that you or third parties provide to us in connection with the mandate existing between us. This also applies to personal data that we collect ourselves.
- Certain personal data is therefore provided directly by you (or other data subjects) when you (or they) contact us by email or telephone to request our services. Such data may include names, contact details or information relating to the role of the data subject within the company or organisation for which you (or the respective contact persons) work, or on whose behalf you (or they) contact us. In the course of performing the mandate, we also process personal data collected from our correspondence with clients or third parties (in particular opposing parties, authorities, courts, their staff or other contact persons). This may include names, contact details, dates of birth, information on employment relationships, income, family situation or health status. Furthermore, we collect certain personal data ourselves, for example from public registers or websites.
- The purpose of processing personal data is primarily to enable us to provide, document and invoice our legal services.
- In order to achieve these purposes, it may be necessary to disclose personal data to the following categories of recipients: external service providers, clients, opposing parties and their legal representatives, business partners with whom we may coordinate legal services, as well as authorities and courts.
- We process personal data within our sphere of responsibility. We may also transfer such data to recipients (in particular clients, opposing parties or authorities) who themselves process personal data in other countries, including countries that do not ensure a level of data protection equivalent to Swiss law. In such cases, such transfers are made solely on the basis of consent or standard contractual clauses. The same applies where data transfer is necessary for the performance of a contract or for the assertion of legal claims.
- We retain personal data for as long as required to fulfil the mandate, but in any event for the legally prescribed retention or documentation period, or as long as there is an overriding private or public interest. We take appropriate and proportionate measures to protect personal data against loss, unauthorised alteration or unlawful access by third parties. If you provide us with personal data relating to third parties (e.g. employees or other contact persons), you are responsible for fully informing them about the data processing carried out by our law firm and other legal or external service providers (e.g. by means of a data protection statement addressed to your employees).
- We draw your attention to the fact that, for the performance of the mandate, we use external IT service providers or cloud providers whose servers are located in Switzerland. We thereby use IT services or communication tools that may involve certain data security risks (e.g. email and video conferencing). Should you wish us to implement specific security measures, please inform us accordingly.
- The purposes described above are based on a legitimate interest in the processing of personal data. Certain processing activities are also necessary for us to fulfil our contractual obligations towards you. The same applies to legal obligations to which we are subject, such as document retention obligations.
- Data subjects have, in particular, the right to obtain information about the personal data stored about them, to know its purpose, to request rectification, deletion or restriction of processing, to object to processing and to lodge a complaint with a supervisory authority. They also have the right to data transmission or portability. Please note, however, that these rights are subject to statutory conditions and exceptions. To the extent permitted or required by law, certain requests may be refused. In particular, we may or must retain personal data or continue to process it in another manner for legal reasons, despite a request for deletion or restriction of processing.
- No formal consent is required from the client, its employees or other contact persons for this data protection statement. This statement merely provides information on the nature, scope and purpose of the data processed by Navarro Maridor Law Firm. We reserve the right to amend this statement unilaterally at any time and without prior notice.
